Terms of Service

These Terms of Service (“Terms”) govern your use of the Web60 WordPress hosting service (“Service”) operated by SmartHost Web Services Limited (“we”, “us”, “our”), a company registered in Ireland.
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Service Description
Web60 provides managed WordPress hosting on infrastructure located in Ireland. The Service includes website provisioning, SSL certificates, daily backups, the Web60 website builder, 24/7 monitoring, and access to the Web60 customer portal.
2. Acceptable Use
You agree not to use the Service to:
- Host content that is illegal under Irish or EU law.
- Distribute malware, spam, or phishing content.
- Attempt to gain unauthorised access to our systems or other customers’ sites.
- Use excessive server resources that negatively impact other customers (we will notify you before taking action).
- Host adult content, gambling sites, or cryptocurrency mining operations.
We reserve the right to suspend or terminate accounts that violate these terms, with reasonable notice where possible.
3. Payment Terms
- The Service costs €60 per year, billed annually in advance.
- Payment is processed securely via Stripe. We do not store your card details.
- Subscriptions auto-renew unless cancelled before the renewal date.
- If payment fails, we will retry twice over 7 days and notify you by email. If payment is not resolved within 14 days, your site may be suspended.
- Free demo sites are provided for 24 hours at no charge.

4. Cancellation
You may cancel your subscription at any time from the Web60 customer portal. Upon cancellation:
- Your site remains accessible until the end of the current billing period.
- After the billing period ends, your site will be suspended and then deleted after 30 days.
- We will send email reminders before deletion.
- You may export your content before cancellation takes effect.
5. Domain Registration Terms
Web60 offers domain registration as part of its hosting service. The following terms apply to all domain registrations made through Web60.
5.1 Non-Refundable
Domain registrations are non-refundable in all cases. Once a domain is registered, the registration fee cannot be reversed. You retain ownership of the domain regardless of whether your hosting service is cancelled.
5.2 Free First-Year Promotion
Eligible domain extensions may be offered at no additional cost for the first year when purchased alongside a Web60 hosting plan. This promotion applies to the first year of registration only. From year two, the domain renews at the standard annual rate. The promotion is limited to one domain per hosting purchase.
5.3 Cancellation Within the Cooling-Off Period
If you cancel your Web60 hosting plan within the 14-day cooling-off period and a domain was registered as part of your order, your refund will be calculated as the total amount paid minus the domain registration cost at the standard registration price (not the promotional price). You keep the domain.
5.4 Cancellation After the Cooling-Off Period
No refund is available for cancellations after the 14-day cooling-off period. Your hosting service continues until the end of the current billing period.
5.5 Domain Renewal
Domains registered through Web60 renew annually at the standard renewal rate. Renewal invoices are generated automatically 30 days before expiry. You are responsible for ensuring your payment details are up to date to avoid domain expiry.
5.6 Domain Ownership
All domains are registered in your name. You may transfer your domain to another registrar at any time, subject to the standard transfer procedures and any applicable lock periods.
6. Suspension and Termination
We may suspend your account immediately if we reasonably believe you are in breach of these Terms, or if required by law. Where possible, we will provide at least 24 hours’ notice before suspension.
We may terminate accounts that remain in breach for more than 14 days after notification. Site data will be retained for 30 days post-termination.
7. Data and Backups
We perform daily automated backups with 7-day retention. While we take every reasonable precaution to protect your data, you are ultimately responsible for maintaining your own independent backups. Our backups are provided as a convenience and are not guaranteed.

8. Uptime
We target 99.9% uptime for the Service, measured monthly, excluding scheduled maintenance. Scheduled maintenance will be communicated at least 24 hours in advance where possible.
9. Limitation of Liability
To the maximum extent permitted by Irish law, SmartHost Web Services Limited’s total liability shall not exceed the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
10. Intellectual Property
You retain full ownership of all content you upload. We claim no intellectual property rights over your content. The Web60 name, logo, and branding are trademarks of SmartHost Web Services Limited.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect.
12. Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
